Augme Technologies’ Patent and Trademark Infringement Case Reactivated (AUGT)
Augme Technologies In. (OTC: AUGT), a technology and services leader in interactive media marketing, on Thursday announced that the U.S. District Court of New York reactivated its patent and trademark infringement case against AOL, Time Warner and Platform-A. The case was filed in 2009.
AUGT said that Hon. Judge Sweet of the U.S. District Court in New York scheduled a pretrial conference for January 25, 2012 for the case. AUGT had filed the lawsuit alleging that AOL, Time Warner and Platform-A are infringing on U.S. Patent No. 6,594,691 and U.S. Patent No. 7,269,636.
Augme Technologies also claimed that AOL infringed on its trademark. The company is seeking injunctive relief and as yet unspecified damages from the alleged infringement.
Paul Arena, CEO of Augme Technologies, on Thursday said that the setting of a trial date for the case represents a major milestone and the company is pleased to report the long-awaited development to shareholders. Arena said that AUGT’s legal counsel, Goodwin Procter, will present a detailed proposal to the court for advancing the case to trial.
Arena said that the company believes it will prevail in the patent enforcement effort and welcomes the opportunity to ensure that it receives full recovery from all of AOL’s infringing activities that are not associated with the operation of the behavioral targeting systems that AOL acquired from Tacoda in 2007.
Earlier this week, AUGT also finalized its 2012 strategy for IP Portfolio Expansion with ipCapital Group, a leading IP strategy consulting firm. Earlier this year, the company had retained ipCapital Group to help in the strategic expansion and monetization of its IP portfolio, following which, ipCapital conducted a comprehensive analysis of AUGT’s IP landscape, along with the deployment of a range of systematic invention and IP strengthening methods that are proprietary to ipCapital Group.
Arena said earlier this week that intellectual property represents a critical component of AUGT’s overall business model and further growth, enhancement and improvement of the patent portfolio if essential to the company’s continued success. Arena also said that AUGT’s IP portfolio, which is available for licensing, is key to the commercial protection of its proprietary media marketing technology and its market position.
